STORE POLICIES

• PURCHASING FIREARMS ONLINE

  It is illegal to ship firearms to anyone not holding an active Federal Firearms License (FFL). For that reason, firearms purchased online may be picked up at our store or shipped to an FFL (gun store) near you. We may contact and verify the FFL you select during checkout before we ship your firearm(s). The buyer is encouraged to contact the receiving FFL licensee before purchase.

• RETURNS

  If you are not satisfied with your purchase, please contact us within 15 business days of purchase.
  
  Sales on the following items are final:

  1. Special orders 
  2. Online orders
  3. Products sold "as is" or "used" or that have been installed or used after receipt.
  4. NFA items.
  5. Illumination devices, electronic sights and optics.

• USED FIREARMS

  Used firearms may not be returned. All sales are final. Description and photos (if available) are provided by the seller.

• Warranty Returns and Coverage

All firearms (excluding Gunbroker firearms) sold by on Target Kalamazoo unless otherwise stated will be covered by the On Target Kalamazoo Warranty.

New Firearms - New Firearms are covered by the manufacturer's warranty with an additional year of coverage through On Target Kalamazoo upon the expiration of the manufacturer's warranty.

Used Firearms - Used Firearms are covered for one year by On Target Kalamazoo.

Gunbroker Firearms - All firearms sold through Gunbroker are not covered by the On Target Kalamazoo warranty. All Gunbroker sales are final.

On Target Kalamazoo will not be responsible for:

• Defects or malfunctions resulting from careless handling, unauthorized adjustments or modifications made or attempted, or improper disassembly and/or reassembly.

• Use of defective or improper ammunition, corrosion, neglect, abuse, ordinary wear and tear, or unreasonable use.

• Criminal misuse, negligence or use under the influence of drugs or alcohol.

• GENERAL FIREARM SALES

  All firearms, magazines, receivers and restricted law enforcement items are sold and shipped in accordance with all existing federal, state and local laws and regulations. Many of the firearms, magazines and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering.
  
  All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories and applicable warranty. Firearms requiring warranty work must be returned to the factory within 1 year of purchase for repair. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special order items.

• SECURE TRANSMISSION

  All information collected during the checkout process is transmitted via industry standard Transport Layer Security (TLS). A Transport Layer Security (TLS) Certificate (or SSL Certificate) creates an encrypted connection between a Web site and a visitor's Web browser. This link ensures that all data passed between the Web site and the browser remains private and secure.

• ORDER FULFILLMENT

  All orders are shipped promptly from a distributor warehouse or in-store inventory within 3 - 10 business days using UPS, FedEx, or USPS. Tracking numbers are available for items shipped via UPS and FedEx.

• ONLINE PRICE & DESCRIPTION ERRORS

  Online inventory changes every day. Occasionally an item may appear on the site by mistake or the item's description may contain a typographical error. We do not guarantee that titles, descriptions, pictures or prices on our site are error-free. We reserve the right to refuse any order including but not limited to orders for items with errors in the description or price. In the event that we cancel an order we will not charge the customer's credit card or we will refund the money.

• AMMUNITION PURCHASES

  You must be 18 or older to purchase rifle or shotgun ammunition and 21 or older to purchase handgun ammunition. All ammunition will be shipped ground with adult signature required. Always make sure to use the correct ammunition for your specific firearms. Check your local laws for any other regulations.

• IN-STORE LAYAWAY

  All Layaway policies are posted throughout the store and at the registers, it is the responsibility of the customer to familiarize themselves with the policy in order to participate in the program. The layaway program is a free benefit and privilege offered to customers at the discretion of the staff.

• LAYAWAY TERMS
  • Customers are limited to 3 active layaways at a time.
  • Minimum down payments:
       $20 if item is under $2,000.00.
       20% if item is over $2,000.00.
  • Payments of at least $5 are due every 14 days.
  • If you swap a layaway, the first transfer is free; any further layaway changes will be
      $10 per transfer.
  • If a layaway is cancelled to a store credit, all money down is applied.
  • If a layaway is repossessed due to non-payment or exceeding 6 months, there will be a $20 restocking fee.
  • If a layaway is cancelled and deposit is taken out of the store, there is a 15% fee.
      This is 15% of the item’s price, not of the payments made.
  • Layaway length is 180 days (6 months).
• On Target Kalamazoo's layaway program is only eligible on in store product, excluding NFA items.

• CONSIGNMENT AGREEMENT

  See below for consignment conditions:

• Terms and Conditions for Consignment Process 

  These terms and conditions govern the consignment process between On Target Kalamazoo, hereinafter referred to as "the Company," and the consignor, hereinafter referred to as "the Consignor," for the sale of firearms or other items. 

  1. Consignment Agreement: By entering into this consignment agreement, the Consignor agrees to consign the specified item(s) to the Company for the purpose of sale. The Company agrees to use its best efforts to sell the consigned item(s) either online or in-store, at its discretion.
  2. Price Determination: The Consignor and the Company will mutually agree upon a sale price for the consigned item(s). Once a price is agreed upon, it shall be considered final, subject to any changes agreed upon by both parties in writing.
  3. Layaway Process: Every consignment is subject to our layaway process, which is offered to customers. The Consignor acknowledges that the Company offers layaway services to buyers and is familiar with the terms and conditions of this process. Details regarding the layaway process are available for review in-store via laminated print-outs placed throughout the store.
  4. Background Check Requirement for Firearms Pickup: If a Consignor wishes to retrieve a firearm that has not been sold or put on layaway, they are subject to a background check as required by local, state, and federal law. The Consignor agrees to comply with all applicable laws and regulations regarding firearm transfers and background checks.
  5. Ownership and Liability: The Consignor retains ownership of the consigned item(s) until sold. The Consignor assumes all risks and liabilities associated with the consigned item(s) until such time as they are sold or returned to the Consignor.
  6. Duration of Consignment: The consignment period shall commence upon the execution of this agreement and shall continue until the consigned item(s) are sold, returned to the Consignor, or until terminated by mutual agreement in writing.
  7. Commission and Fees: The Company shall be entitled to a commission on the sale of consigned item(s), as agreed upon between the parties. Any applicable fees, such as storage, repairs or advertising fees, shall be deducted from the proceeds of the sale before remittance to the Consignor. The commission rate is based on the sale price of the item(s). Item(s) selling for $200 or less will have a company commission rate of 25%, and all items sold for over $200 will have a company commission rate of 20%.
  8. Withdrawal of Consignment: The Consignor may request the withdrawal of consigned item(s) at any time, provided that the item(s) is not subject to an active layaway or Gunbroker auction. The Consignor acknowledges that a withdrawal fee may apply, as outlined in the terms of this agreement.
  9. Indemnification: The Consignor agrees to indemnify and hold harmless the Company from any claims, damages, liabilities, or expenses arising out of or related to the consigned item(s), including but not limited to claims of infringement or misrepresentation.
  10. Governing Law: This agreement shall be governed by and construed in accordance with the laws of Michigan. Any disputes arising out of or related to this agreement shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.
  11. Entire Agreement: This agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, negotiations, and discussions, whether oral or written.

  On Target Kalamazoo reserves the right to refuse to consign an item(s) at the employees discretion. In most cases, only firearms (firearms, muzzle loaders and antiques) will be eligible for consignment.

• SAFE MOVING DAMAGE WAIVER

  1. Limited Liability: On Target Kalamazoo agrees to take all necessary precautions and measures to ensure the safe relocation within the customer's home. However, On Target Kalamazoo shall not be held liable for any damage that may occur during the relocation process. The customer acknowledges and understands that there is an inherent risk of damage due to the weight and/or orientation and layout of the space.
  2. Customer's Responsibility: For relocations, the customer is responsible for ensuring the safe is adequately prepared for relocation, including securing any loose items inside the safe. On Target Kalamazoo will not be liable for damage caused by inadequate preparation of the safe.
  3. 3. Entire Agreement: This damage waiver constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements, understandings, or representations, whether oral or written.
• STORED/ABANDONED FIREARMS
• • Firearms in On Target Kalamazoo's possession for gun smithing or FFL transfer will be subject to storage and abandonment rules.
  • After 3 months of a firearms completion of gunsmithing work or arrival for FFL transfer, the firearm will be subject to a storage fee of $30 a month that will be assessed upon its transfer fee or smithing costs and must be paid before the firearm can be retrieved.
  • After 6 months, the firearm will be considered abandoned and will be taken into On Target Kalamazoo's inventory. Upon seizure of the firearm, a store credit will be generated for wholesale value of the item(s).

On Target Kalamazoo will make every reasonable effort to contact the owner. Exceptions can be made with prior contact under special circumstances. If you would like to apply for a pickup extension, please contact the store during operating hours. 

• RIGHT TO REFUSE
• On Target Kalamazoo reserves the right to refuse a sale at any time. 
• Examples of reasons for refusal include but are not limited to:
• Improper identification or documentation, reasonable belief of intoxication, marijuana use, straw purchase, ect.
